You will go to prison when you are convicted of a gun crime committed in Wicomico County, even for a first offense, even if you are a minor. No parole, no work release, far from home, family and friends.

The State's Attorney's Office and Federal Prosecutors will aggressively pursue all available Minimum/Mandatory and No Parole sentences available for Gun Crime.

There is No Parole or Work Release in Federal Prison. Federal Prisons are far from home.

There are 5 Year Minimum/Mandatory sentences without Parole in Maryland for:

  1. Possession of a firearm while engaged in a drug trafficking crime;
  2. Possession by a person previously convicted of a felony crime of violence or felony CDS crime;
  3. Use of a handgun in a crime of violence.

Minors can get 5 years in the Maryland Division of Corrections for possession of a handgun.

Persons previously convicted of a misdemeanor who possess a handgun can get 5 years in the Maryland Division of Corrections.

Transorting a handgun in a vehicle or on your person can get you 3 years in prison. That jumps to 10 years for a second offense.

There is a 15 year Minimum/Mandatory prison sentence in Federal Court for possession of a firearm if you were previously convicted 3 times of Crime of Violence or Drug Trafficking Crime.
